Terms of Service

1. Who and what
These terms are between you and Nicola Faieta, Viale Muzii 91, 65123 Pescara, Italy, VAT IT02333630685 ("PlugTrade", "we"). They cover the website plugtrade.io, the PlugTrade software and the PlugTest application, during their early-access period and after it.
By requesting access, creating an account or using the software you accept these terms. If you do not agree, do not use the service.
We may change these terms. Material changes are announced by email or with a notice on the website at least 30 days before they take effect. If you keep using the service after that date, the new terms apply.
2. The products
- PlugTrade is Windows software you install on your own VPS. It receives TradingView webhook alerts and places orders in your MetaTrader 5 terminal on that VPS, without routing the alerts through external cloud servers. The service also includes the website, your account, licence management and support.
- PlugTest is a desktop application that replays historical market data so you can practise and journal trades on your own computer.
3. Access and accounts
During early access, both products are available by invitation or early-access request. We can grant, limit or withdraw access at our discretion during this period.
PlugTrade needs an account. You agree to give accurate registration details, keep your credentials secret, tell us at once of any unauthorised use, and answer for everything done under your account.
You must be at least 18 years old. A licence key is valid on the number of devices your plan allows, one VPS unless the plan says otherwise.
4. Licence
Subject to these terms and, for paid plans, to an active subscription, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the software for your own trading. You may not:
- resell, sublicense or share the software, your access codes or your licence key;
- reverse engineer, decompile or disassemble it beyond what the law allows;
- circumvent licence checks or authentication;
- use it to provide a service to others, or for any purpose that breaks the law.
5. Prices, trials and payments
Early access is free unless stated otherwise. Prices shown on the website are indicative for the public release and may change before it. Each paid plan has its own conditions at the time of purchase; the rules below apply once paid plans are on.
- Trial. New subscribers get a 7-day free trial with full access, started at checkout. Nothing is charged during the trial. Signups through a referral link get a 14-day trial without entering a card.
- Billing. After the trial, subscriptions are billed monthly at the current rate. Payments, tax and invoices are handled by Paddle, our Merchant of Record and the seller of record for every transaction.
- Cancellation. Cancel at any time from your dashboard. Access continues until the end of the paid period.
- Refunds. 14-day money-back guarantee from your first payment. After that, refunds are at our discretion, without prejudice to your rights as a consumer.
- Price changes. We give at least 30 days' notice before a price change reaches existing subscribers.
6. Not financial advice, risk warning
PlugTrade is a software tool. We are not a broker, financial adviser, signal provider or investment manager. We do not give trading signals, investment advice or recommendations. Sample trades, timings and figures on the website are illustrations.
Trading forex, CFDs, futures and other leveraged instruments carries a high risk of losing money. You can lose your entire capital and, with some brokers, more than your deposit. Only trade with money you can afford to lose. Past performance of any strategy, system or signal is no indication of future results.
Every decision to place, modify or close an order is yours, including orders produced automatically by alerts you configured.
7. Your responsibilities
- The VPS, the MetaTrader 5 terminal, the broker account and their credentials are yours. We never hold them.
- You are responsible for the alert messages you configure in TradingView, for the parameters and risk settings you apply, and for the orders they produce.
- You are responsible for keeping the software updated and your server reachable.
- You are responsible for complying with the laws that apply to you, including financial-services rules, tax obligations and anti-money-laundering requirements.
8. Acceptable use
You agree not to use the service to break any law, to gain unauthorised access to our systems or other users' accounts, to interfere with the service or its infrastructure, for money laundering or fraud, or to resell or commercially exploit the service without our written consent.
9. Warranties and liability
The software is provided "as is" and "as available". During early access it may contain defects. To the extent the law allows, we give no warranty, express or implied, about accuracy, reliability, uninterrupted operation, execution speed or fitness for a particular purpose, and no warranty about any signal, webhook payload or execution result that passes through the software.
To the extent the law allows, we are not liable for trading losses, loss of profit, loss of data or business interruption, nor for losses arising from signal errors or delays, missed or duplicated orders, wrong lot sizes, slippage, partial fills, broker rejections, data-feed errors, network outages, software bugs, or downtime of third parties (TradingView, your VPS provider, your broker).
Our total liability for any claim arising from these terms or from your use of the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim, or EUR 100, whichever is lower.
Nothing in these terms excludes or limits liability for wilful misconduct or gross negligence, or any liability that cannot be excluded under Italian law or under the mandatory consumer protection rules of the country where you live.
10. Assumption of risk
By using the software you knowingly accept the risks of automated execution based on third-party alerts: alerts that are wrong, delayed, duplicated or lost; differences between the intended and the actual execution; conflicting signals executed at the same time; software crashes or unexpected behaviour; connectivity problems; broker requotes, spread widening or rejections. You confirm you have the knowledge, experience and financial resources to evaluate these risks and bear any resulting loss.
11. Indemnity
You will indemnify and hold us harmless from claims, damages, costs and reasonable legal fees arising from your use of the service, your trading and its outcomes, third-party claims about trades executed through the software, or your breach of these terms or of the law.
12. Termination
You can stop using the software at any time and cancel a subscription from your dashboard; access continues until the end of the paid period. We can suspend or end your access at once if you breach these terms, commit fraud or abuse the service, and when the early-access programme ends. On termination the licence ends. The sections on liability, indemnity and disclaimers survive.
13. Intellectual property
The software, the website, the trademarks and all related intellectual property belong to us or our licensors. These terms give you no right to them beyond the licence in section 4.
14. Law and disputes
Italian law applies. The courts of Pescara have jurisdiction, without prejudice to the mandatory protections consumers have in their EU country of residence, including the right to bring a claim before the courts of that country.
15. Severability
If a clause of these terms is invalid or unenforceable, it is limited or removed to the minimum extent needed and the rest stays in force.
